2020 Lasting Impacts for CA Employers

Updated: Feb 1, 2021

Among the lasting 2020 impacts of fires, politics and COVID-19, is the increased regulation of California employers. Take a look at the AB 685 and SB 923 below.

COVID-19 Infection Prevention Requirements (AB 685) requires employers who receive “notice of potential exposer” to COVID-19 to provide notice within one business day:

1. In writing to all employees, and the employers of subcontracted employees who were on the premises at the same worksite (workplace) “within the infectious period” that they may have been exposed to COVID-19;

2. To all employees who may have been exposed and their exclusive representatives, if any, with information regarding COVID-19 related benefits to which they may be entitled;

3. To all employees, the employees of subcontracted employees and the exclusive representative, if any, of the disinfection and safety plans that the employer plans to implement and complete, per Federal CDC guidelines.

California's pay-data reporting requirement (SB 923) requires employers with 100 or more employees to submit a pay data report to the Department of Fair Employment and Housing by March 31, 2021, and annually thereafter.
